  • Hoekom is werkspermitte belangrik vir buitelandse burgers?

Werknemers wat buitelandse burgers is moet in besit wees van ‘n geldige paspoort/ID en die nodige werkspermitte wat in Suid-Afrika vereis word, voordat hulle vir ‘n Suid-Afrikaanse besigheid kan werk. Dit is onwettig om ‘n buitelander in diens te neem wat nie ‘n geldige werkspermit en paspoort het nie. Die indiensneming van buitelanders in Suid-Afrika word gereguleer deur die Immigrasiewet 13 van 2002 (soos gewysig). Artikel 38 van die Immigrasiewet bepaal dat geen persoon ‘n onwettige buitelander in diens mag neem nie en plaas ‘n plig op die werkgewer om vas te stel wat die status of burgerskap van die persoon in diens is. Dit beteken dat dit die bestuur se verantwoordelikheid sal bly om te verifieer of die dokumente wat verskaf word wettig is.

Produsente moet ‘n werwingstelsel in plek hê om te verseker dat alle werknemers ‘n afskrif van hul ID, paspoort, en werkspermit verskaf om verskeie aspekte te bevestig, soos byvoorbeeld:

  • Is die werknemer ‘n wettige buitelander wat die nodige dokumentasie in plek het?
  • Tot wanneer is die permit en paspoort geldig?
  • Is die werknemer se ouderdom geskik vir werk en ooreenkomstig met wetgewing? Dit is belangrik om te onthou dat ‘n werkgewer nie enige kind onder die ouderdom van 15 jaar mag aanstel of toelaat om by enige vorm van arbeid betrokke te raak nie.
  • Waar jong werkers betrokke is, moet die onderneming voldoen aan die vereistes wat deur die wet gestel word rakende werksomstandighede vir werknemers van 15 tot 17 jaar.
