There has been some confusion from some businesses on whether seasonal workers must be paid for public holidays, even if they do not work on the public holiday. In terms of labour legislation, all employees have the same rights, unless explicitly stated otherwise.
Employees are not required to work on a public holiday unless an agreement has been reached with the employer to work on that day.
Payment on public holidays can be difficult when the work is conducted on a day the employee would normally have worked versus a day the employee would not normally have worked.
