Any person deemed to be an employee and who fits the definition of an employee according to Basic Conditions of Employment Act (BCEA) Chapter 11 Section 83, must be recognised by the business as an employee through means of an employment contract.
In cases where seasonal workers are employed for the same length of time and under the same conditions of employment, ‘group contracts’ are sometimes entered into in agriculture.
Section 9 of Sectoral Determination 13 is very clear in its requirement that employees should receive written particulars of employment (contract) when they start work.
